A federal appeals court just dropped a major ruling that could change the game for hemp-derived products in the south. The Eighth Circuit Court of Appeals officially upheld Arkansas's strict hemp restrictions, essentially confirming that states have the power to be more restrictive than the 2018 Farm Bill. This decision directly undercuts Texas Governor Greg Abbott’s recent veto of a similar THC ban in his own state, where he argued such laws were unconstitutional and likely to fail in court.
With this legal green light, Texas Lt. Governor Dan Patrick is already pushing to reintroduce their ban during a special session.
