Virginia Gov.-Elect Abigail Spanberger Supports Adult-Use Cannabis Sales

Abigail Spanberger (D), a former Congresswoman and CIA officer, was elected as Virginia's governor, defeating Republican Winsome Earle-Sears. She succeeds Republican Glenn Youngkin, who had blocked adult-use cannabis sales. Spanberger, who has an 'A' grade from NORML, promised during her campaign to allow adult-use cannabis sales and work with the General Assembly to create a legalized retail market focused on public safety and economic growth. In Congress, she supported the SAFE Banking Act and legislation to remove cannabis from the Controlled Substances Act, and allow states to set their own policies.

New Jersey’s Incoming Governor Supports Legalizing Marijuana Home Cultivation

Mikie Sherrill, the incoming governor of New Jersey, supports legalizing home cultivation of marijuana, a policy reform long awaited by consumers and advocates. Her priorities also include preventing youth access to THC products, effectively distributing tax revenue, and addressing the lack of a home grow option. Current Governor Phil Murphy opposes home cultivation at this time. During her time in Congress, Sherrill voted in favor of federal legalization and social equity bills, supported federal rescheduling of marijuana, and consistently backed the SAFE Banking Act. She has also worked on defense legislation amendments related to cannabis use waivers and drug conviction expungements.

Virginia’s Newly Elected Governor Supports Legalizing Recreational Marijuana Sales

Abigail Spanberger, Virginia's newly elected Democratic governor, supports legalizing adult-use marijuana sales, a change from the outgoing Republican governor, who had vetoed previous attempts. Spanberger emphasizes the need for a safe, transparent, and fair retail market, with revenue reinvested in communities like public schools. Use and possession of marijuana are currently legal in Virginia, but retail sales are banned, fueling an illicit market. Spanberger defeated Lt. Gov. Winsome Earle-Sears, who had opposed the reform. With an expanded Democratic majority in the legislature, advocates believe the state now has the opportunity to establish a regulated adult-use cannabis market, with legislative commissions already working on a proposal for the 2026 session.

Virginia Medical Cannabis Company Sues DoorDash for Delivering Illegal Intoxicating Hemp Products

A Virginia medical cannabis company, Dalitso LLC (Hello Cannabis Dispensary), has sued DoorDash, Total Wine & More, and other distributors, alleging they conspired to sell "intoxicating cannabinoid products" disguised as legal hemp. The lawsuit claims Total Wine sold a product with a THC concentration (5.65 mg) exceeding Virginia's 2-milligram hemp limit, and DoorDash delivered it, giving the defendants an "unlawful economic advantage" over licensed dispensaries. Dalitso is seeking $20 million in damages, triple damages under the business-conspiracy statute, and court orders to stop unlicensed cannabis deliveries.

39 Bipartisan State And Territory Attorneys General Push Congress To Ban Intoxicating Hemp Products

A bipartisan coalition of 39 state and territory attorneys general is urging Congress to clarify the federal definition of hemp in the 2018 Farm Bill and impose regulations to prevent the sale of intoxicating cannabinoid products, arguing that the current interpretation has been exploited to sell synthetic THC products, often marketed to minors. They are asking for legislative changes to make these products illegal. Industry stakeholders, however, express concern that a ban could jeopardize the entire hemp market and suggest a middle-ground approach with age-gating and safety standards. Separately, Senator Rand Paul (R-KY) is advocating for a study into state regulatory models and has proposed legislation to triple the legal THC concentration for hemp, opposing efforts by Senator Mitch McConnell (R-KY) to champion criminalization language.

West Virginia Medical Marijuana Revenue Is Supposed To Support Drug Treatment Programs, But Sits Unspent As Officials Worry About Federal Prohibition

West Virginia's medical cannabis program has collected approximately $34 million in taxes and fees since 2021, which state law requires be used for a medical cannabis research program, substance use disorder resources, and law enforcement training. However, the money remains unspent because cannabis is illegal at the federal level, and traditional banks refused to hold the funds. The money is currently held by a credit union, and the treasurer's office states it will remain unallocated until federal law changes. Other states with legal cannabis markets are spending their tax revenue. Lawmakers who drafted the original legislation expressed surprise that the funds are stockpiling. If the money were distributed today, it would be allocated to public health, substance abuse programs, and law enforcement training.

Frequent Marijuana Use Is Tied To Lower Risk Of Liver Disease From Alcohol, New Study Finds

A new study found that frequent marijuana use, particularly among those meeting the criteria for "cannabis use disorder" (CUD), is associated with a reduced risk of developing alcohol-associated liver disease (ALD) compared to both infrequent users and non-users. The researchers theorize that the non-intoxicating cannabinoid CBD may be responsible for this protective effect, and suggest that the cannabinoid system could be a promising therapeutic target for ALD. The study found a 40% reduction in the composite ALD, a 17% reduction in hepatic decompensation, and a 14% reduction in all-cause mortality associated with cannabis use.

State officials and legislators, including those who wrote the cannabis banking legislation, were reportedly unaware the funds were unspent. The funds are legally required to establish a medical cannabis research program, provide resources for substance use disorder, and fund law enforcement training, none of which have been created or funded due to the money being held. Ohio Lawmakers Advance Bill To Scale Back Voter-Approved Marijuana Law And Impose Hemp Regulations

Ohio House lawmakers approved an amended Senate-passed bill that significantly alters the state's voter-approved marijuana legalization law and introduces new regulations for hemp, aiming to align the two sectors. The bill includes same potency and advertising restrictions for hemp as marijuana, permits the sale of hemp-derived THC beverages (with limits on THC content and new taxes), and restricts where intoxicating hemp products can be sold to licensed dispensaries. Controversial provisions remain, such as the elimination of anti-discrimination protections for cannabis users and the recriminalization of possessing marijuana not sourced from a state-licensed dispensary or home grow. Advocates are concerned the bill rolls back voter-enacted freedoms. Unlike the Senate version, the House substitute will send tax revenue from cannabis sales to local governments. The bill also includes a process for expunging prior cannabis possession convictions.

Ohio Lawmakers Will Take Up Bill To Revise Voter-Approved Marijuana Law And Add Hemp Market Restrictions This Week

Ohio House lawmakers are set to revise the state's voter-approved marijuana legalization law, primarily by focusing the proposal on regulating intoxicating hemp products and scaling back controversial restrictions on the marijuana market. The legislation, using Senate Bill 56 as a vehicle, will still address the recreational marijuana program, including tax revenue allocation. Under a planned amendment, stores and breweries could sell THC beverages, but high-THC hemp products would be temporarily banned while rules are developed. The effort to regulate hemp follows a blocked executive order to ban intoxicating hemp products. Lawmakers, including Rep. Jamie Callender, believe combining marijuana and hemp regulations in the bill may compel the Senate to accept the House's preferred marijuana provisions. Meanwhile, the Ohio Department of Cannabis Control (DCC) has also filed new proposed rules regarding labeling and packaging for the existing marijuana market, which has already seen over $3 billion in sales.

How Cannabis Regulators Can End The ‘Croptober’ Crisis Of Product Inversion (Op-Ed)

The article discusses the issue of "inversion" in New York's cannabis market, where cannabis from oversupplied states like California and Michigan is falsely sold as locally produced. This practice, known as Croptober, is becoming increasingly prevalent due to weak oversight and delayed implementation of tracking systems. The article explains how inversion works through fake harvest reports and inflated extraction yields, leading to consumer distrust and an unstable market. It proposes solutions for New York, including routine audits, surprise inspections, structural reforms like canopy caps, and consumer-facing accountability through product labels. The author, Damian Fagon, emphasizes that state-level reforms are crucial, but a national imbalance created by oversupplied states also needs to be addressed.

Virginia’s New Medical Marijuana Tracking System Shows Strong Sales, Even As Patients Complain About High Prices

Virginia's new seed-to-sale medical cannabis tracking system, operated by the Virginia Cannabis Control Authority (CCA) and Metrc, has been online for two months, providing real-time data on plants, products, and sales. This system helps the CCA track popular products, plant growth, and sales trends, aiming to protect patients and prevent illegal products. Early data shows nearly half of sales were flower, with concentrates, edibles, and shake trim making up the rest. The CCA plans to create a public dashboard for data transparency. Patients continue to express concerns about high prices and limited access, with some traveling to neighboring states for cheaper products. The system's unveiling coincides with a debate in the General Assembly about legalizing recreational cannabis sales, which lawmakers are considering for as early as 2026. The CCA's current focus remains on refining the medical program and ensuring public safety, with the tracking system allowing regulators to trace products and reduce risks.

Virginia Candidates For Governor Have Contrasting Marijuana Stances As Early Voting Begins

Virginia's upcoming gubernatorial election will significantly impact the future of recreational marijuana sales in the state, with the two leading candidates holding opposing views. Current Lt. Gov. Winsome Earle-Sears (R) strongly opposes legalization, citing concerns about it being a "gateway drug" and "decimating communities." In contrast, former U.S. Rep. Abigail Spanberger (D-VA) supports establishing a regulated cannabis market, emphasizing public safety, economic growth, and reinvesting tax revenue into communities and public schools. While possession and home cultivation of marijuana have been legal since 2022, retail sales remain forbidden due to Governor Youngkin's vetoes of previous legislative efforts. The new governor will likely determine whether regulated sales become a reality in Virginia.

Pending Federal Hemp Legislation Could Reshape The Legal Industry By Banning Some Products (Op-Ed)

Pending federal legislation could significantly change the hemp industry by redefining THC limits, excluding synthetic and converted cannabinoids, and potentially imposing a "no quantifiable" THC threshold. These changes would disrupt current business models and create compliance challenges, potentially pushing products to the illicit market. An alternative, more regulatory approach, similar to Rep. Griffith's bill, is also being considered, which focuses on health and safety with specific THC thresholds and labeling requirements. The outcome of these debates will determine the future economic viability of the hemp industry in the United States.

Pennsylvania GOP Senator Says Marijuana Legalization Supporters Are ‘Picking Up Votes’ As Officials Work To Finalize Budget Deal

A Republican Pennsylvania senator, Dan Laughlin, believes that supporters of marijuana legalization are gaining votes to pass reform this session. He states that people prefer legalizing cannabis for revenue rather than increasing taxes to balance the budget. Laughlin, along with Sen. Sharif Street, introduced a bill to legalize adult-use cannabis. There are also other proposals, including a House companion version, under consideration. Despite previous setbacks, lawmakers are optimistic about passing a bill that would also include sealing and expunging cannabis-related convictions. However, there are conflicting views on the model of cannabis sales (state-run vs. private businesses) and the political dynamic with a GOP-controlled Senate. Despite these challenges, polls show strong public support for legalization. The governor also supports legalization, emphasizing economic benefits and public safety.

Houses In Legal Marijuana States Are Worth More And Grow In Value Faster Than Those Where Criminalization Remains, Study Shows

A new study by Clever Offers shows that home values in states where adult-use marijuana is legal have increased by $60,327 more on average between 2009 and 2024 compared to states where it remains criminalized. The report states that recreational cannabis states saw an average home value increase of $222,958, while non-legal states saw an average increase of $162,631. As of 2024, the average house in a legal marijuana state was worth $447,635, about 39% more than the average house price in non-recreational states. The study also found that states with only medical marijuana legalization saw greater home price increases ($22,185 more) than states where cannabis remains outlawed. Pennsylvania’s GOP Senate Majority Leader Throws Cold Water Marijuana Legalization Plan

A bipartisan bill to legalize recreational cannabis in Pennsylvania was introduced by Senators Dan Laughlin and Sharif Street, but it faces opposition from Senate Majority Leader Joe Pittman, who does not see a prevailing view for legalization within the Republican caucus as part of the current budget negotiations. The bill proposes legalizing cannabis for those 21 and over, with a 6% sales tax and 8% excise tax, and would expunge non-violent cannabis convictions. Despite broad Democratic support and calls from Gov. Nebraska Governor Approves Medical Marijuana Rules Banning Flower Access For Patients

Nebraska Gov. Jim Pillen has approved emergency rules for licensing medical cannabis establishments, with licensing to begin by October 1. The regulations were imposed by voters last November, legalizing medical cannabis with a healthcare practitioner's recommendation. The Nebraska Medical Cannabis Commission will regulate the new medicine. The rules set criteria for licenses (cultivator, manufacturer, dispensary, transporter), including ownership, fingerprinting, location restrictions, and prohibited persons. Dispensaries are limited to one per judicial district and can sell specific products like oral tablets, tinctures, gels, and patches, but not raw plant, edibles, or products for smoking/vaping. Public feedback on the emergency regulations is open until July 15. Advocates have expressed concerns about the ban on whole-plant cannabis and restrictions on usage methods. While marijuana use and possession have been legal since 2022, retail sales are still forbidden, fueling an illicit market. Governor Glenn Youngkin has twice vetoed proposals for regulated sales, but with his term ending, the next governor will likely decide the fate of retail cannabis. The commission, in place until mid-2028, will gather public input and make recommendations on various policy matters for Virginia's transition to a commercial adult-use market, including licensing, taxes, employment protections, and labor union agreements. Advocacy groups like Marijuana Justice and NORML plan to participate, while the Virginia Cannabis Association does not, focusing instead on reintroducing previously vetoed legislation. The outcome of the upcoming gubernatorial election is seen as crucial for the future of cannabis retail in Virginia.

New Bipartisan Pennsylvania Bill Would Create Marijuana Regulatory Board Ahead Of Possible Adult-Use Legalization

Pennsylvania senators have introduced a bipartisan bill to create a new regulatory body, the Cannabis Control Board (CCB), to oversee medical cannabis and prepare for eventual adult-use legalization. The bill, sponsored by Senator Dan Laughlin, aims to establish a transparent and efficient framework for the cannabis industry, ensuring the state is ready when adult-use legalization passes. The CCB would consolidate oversight, enhance transparency, and manage the industry. While the bill doesn't explicitly legalize adult-use cannabis, it sets up the infrastructure for it. Democrats and some Republicans support legalization due to public health and safety concerns, economic benefits, and competitiveness with neighboring states that have already legalized. Despite bipartisan voter support, the reform faces hurdles in the legislature due to conflicting views on a state-controlled versus private sales model and the need for Republican support in the GOP-controlled Senate.

‘Justice Is Still Being Denied’ To People With Past Marijuana Convictions As Legalization Spreads, Review By Advocacy Group Says

State legislatures considered criminal justice reform bills related to marijuana, but many failed. The Last Prisoner Project (LPP) calls this the "hidden crisis in cannabis reform." Bills to seal records and release incarcerated individuals fell short in several states. Virginia's resentencing bill was vetoed. However, Maryland and Hawaii saw landmark victories in record relief and expungement. LPP advocates for addressing past drug war harms and urges action on cannabis justice.

GOP Senators File Bill To Ramp Up Criminalization Of ‘Candy-Flavored’ Marijuana Edibles

A coalition of Republican senators have reintroduced a bill that would increase criminal penalties for a wide range of offenses, including manufacturing or selling Schedule I drugs like marijuana in the form of candy or beverages if there is “reasonable cause to believe” they will be sold to minors. The bill targets substances in Schedule I or II of the federal Controlled Substances Act (CSA), including cannabis. The legislation doesn’t explicitly mention marijuana, but a section-by-section analysis says that manufacturers and traffickers of marijuana edibles and fentanyl and other illicit drugs are marketing and distributing these highly dangerous drugs as packaged candy. If enacted, people who are federally prosecuted for such criminal activity could face up to 10 additional years in prison for a first offense if the cannabis product sold to a person under 18 was shaped or flavored like candy. Second and subsequent offenses would carry up to 20 additional years in prison.
