Hemp Isn’t A Loophole—It’s A Legal Industry, And It’s Under Attack (Op-Ed)
A proposed policy change slipped into a budget deal aims to eradicate the legal hemp industry, which would wipe out a $28+ billion market and 300,000 jobs while driving production to the black market. The author argues that Congress should choose regulation—with testing, potency limits, and age gating—over prohibition to address public safety concerns properly.

West Virginia’s High Medical Cannabis Prices Push Patients To Buy Recreational Marijuana In Neighboring States
West Virginia's medical cannabis patients are struggling with high prices and limited product access, leading many to illegally cross state lines to purchase cheaper recreational cannabis and edibles in neighboring states like Ohio and Maryland. The state's medical cannabis program has high overhead costs due to factors like no outdoor growing, a 10% sales tax on dispensaries, and lack of insurance coverage or tax exemptions due to federal illegality. Patients and advocates are pushing for an expansion of the program, potentially to a recreational market, to lower costs and broaden access, but state officials have not implemented price caps or changed the Medical Cannabis Act since 2021.

Virginia Lawmakers To Unveil Marijuana Sales Legalization Plan They Want To Pass In 2026 Under New Governor

Glenn Youngkin. The Joint Commission on the Future of Cannabis Sales will present its finalized proposal on December 2nd, with sales potentially starting as early as fall 2026. The legislation aims to create a well-regulated market, address historical injustice, and direct tax revenue toward priorities like education, while combating the current illicit market. Equity advocates are urging for stronger provisions to ensure fair competition and investment in disproportionately harmed communities. The Virginia Cannabis Control Authority (CCA) also recently launched a new portal to streamline medical cannabis certification.

House Committee Blocks Vote On GOP Lawmaker’s Amendment To Stop Hemp Ban, While Senator Floats Regulatory Alternative
The House is preparing to vote on a Senate-passed spending bill that includes a ban on consumable hemp products. Attempts by Republican Representatives Paul Rand and Thomas Massie to strike the prohibition language failed. Republican Representative Morgan Griffith is voting for the underlying bill to avoid a government shutdown, despite disagreeing with the hemp ban. Democratic Senator Chris Van Hollen supported the ban due to concerns about unregulated synthetic hemp products being sold to children, but suggests Congress should use the one-year before implementation to develop a regulatory framework to preserve access to safe hemp products like CBD. Advocates are also criticizing the bill for omitting bipartisan provisions allowing VA doctors to recommend medical cannabis.

Beer Industry Trade Group Calls Out Hemp THC Sector’s ‘Bad Actors’ For Allegedly Marketing To Children
The American beer industry is campaigning against makers of THC-infused beverages, seeking federal regulation for these products which are currently mostly regulated by state laws. Beer industry representatives argue that "bad actors" in the THC sector are exploiting a loophole in the 2018 Farm Bill, leading to the sale of highly potent, unregulated THC products, sometimes marketed to children. Minnesota's Attorney General Keith Ellison, along with 38 others, signed a letter urging Congress to clarify the federal definition of hemp, which has raised concerns in the state's established THC market. While some in the THC industry, like Cann cofounder Jake Bullock, support regulations to curb synthetic products and child marketing, they warn that overly broad regulations could harm the growing industry. The debate over the future of THC-infused products is ongoing in Congress, with small brewers increasingly entering the hemp beverage market.

He sees THC drinks as a good entry-level product and argues that cannabis should be as easy to purchase as alcohol. Rogen also commented on the evolving public perception of cannabis, noting how stigmas are dissolving as people question the original reasons for its prohibition. Additionally, he discussed his role in advocating for cannabis reform.
