Texas voters are currently voting in a primary election that includes a non-binding Democratic proposition on whether to legalize cannabis and expunge past low-level convictions. While the vote will not immediately change state law, the Texas Department of Public Safety and Department of State Health Services are already moving to expand the state's medical marijuana and hemp programs.

Marijuana Moment

Texas voters are finally getting a chance to speak up about cannabis legalization. During the current primary election, Democratic ballots include a non-binding proposition asking if the state should legalize adult-use marijuana and wipe away past low-level convictions. While this vote won’t change the law overnight, it’s a massive chance for the community to show lawmakers exactly where the people stand. Even better, Texas has an open primary, so any registered voter can grab a Democratic ballot to weigh in.

Behind the scenes, the state is already slowly opening up. Officials recently approved nine new medical licenses, with more on the way by 2026, which is a huge jump from the mere three dispensaries currently operating. Regulators are also fine-tuning rules for hemp products and medical qualifying conditions. For regular tokers, this matters because it’s the clearest signal yet that the "prohibition wall" in Texas is cracking. Participation in these polls builds the political pressure needed to move from non-binding questions to real, accessible retail markets and social justice reform.
