The Alabama ABC Board approved an emergency rule regulating consumable hemp products and creating the Responsible Consumable Hemp Product Program, despite opposition from the law's sponsor, Rep. Andy Whitt, who argued the rule exceeds statutory authority. Board members defended the temporary rule as necessary to protect retailers and consumers until a permanent version could be implemented.

Alabama’s hemp scene just got a major update, though not everyone is on board. The state’s ABC Board pushed through a temporary emergency rule to manage consumable hemp products through a new "Responsible Consumable Hemp Product Program." This move sets up specific testing, labeling, and THC limits—10mg per item and 40mg per pack—while establishing a system of warnings and fines for retailers and distributors. Interestingly, the lawmaker who originally sponsored the state’s hemp law, Rep. Andy Whitt, is crying foul, claiming the board is overstepping its legal authority and creating programs the legislature never asked for.

For the local community, this is a bit of a double-edged sword. On one hand, having clear standards for testing and labeling is a win for anyone who wants to know exactly what’s in their gummies or tinctures. It brings some much-needed legitimacy and safety to the "Wild West" of the hemp market. On the other hand, heavy-handed regulations and extra fees can sometimes squeeze smaller shops, making it harder for your favorite local spot to stay stocked. Keeping things safe is great, but we always hope it doesn't come at the cost of variety and access.
