Utah Cannabis Company Fails to Block Unionization Using Federal Law Loophole

A federal judge in Utah has delivered a significant victory to cannabis workers by rejecting a dispensary operator's attempt to use federal prohibition to block unionization. The company, operating under the name The Flower Shop, had argued that because marijuana remains illegal under federal law, the National Labor Relations Act should not apply to its operations or protect employees from anti-union retaliation.

U.S. District Judge Anne Marie McIlff Allen denied the company's request for a preliminary injunction, clearing the way for the National Labor Relations Board to proceed with its case against the employer. The union involved, United Food and Commercial Workers Local 99, has accused the business of unlawfully terminating four employees due to their organizing activities.
