  • California Moves to Permanently Ban Hemp THC Products | Toker's Guide

The California Department of Public Health (CDPH) announced a permanent ban on hemp-derived THC products. The ban, supported by Gov. Gavin Newsom, aims to regulate the cannabis industry and address the risks of untested products. Licensed cannabis sales in California have dropped 11% this year. < Back California Moves to Permanently Ban Hemp THC Products Jun 16, 2025 Graham Abbott Ganjapreneur Article Link Facebook X (Twitter) WhatsApp LinkedIn Pinterest Copy link The California Department of Public Health (CDPH) announced Friday that the state would move to make permanent its temporary ban on hemp-derived THC products, SF Gate reports. Led by Gov. Gavin Newsom (D), state lawmakers approved emergency rules containing the temporary ban last September. The six-month policy took effect immediately, and Newsom later extended the ban for another six months in March. The current policy is now set to expire in September. The permanent ban proposed by CDPH now enters a 45-day public comment period and there will be a hearing sometime next month to hear input from the public. Newsom advocated for the ban last year, arguing that hemp-derived THC products circumvent the state’s highly regulated cannabis industry, which in turn undercuts the state-licensed companies trying to operate in the legal cannabis space. Before the ban, individuals could purchase THC-infused gummies, beverages, and other products from ordinary retailers including gas stations and convenience stores — additionally, the products were largely untested for pesticides, additives, and other contaminants. Last month, the governor’s office said the state boasted a 99.7% compliance rating with the hemp products ban among businesses visited by state officials. Meanwhile, licensed California cannabis sales experienced an 11% sales drop during the first quarter of this year, compared to last year. It marked the largest decline in legal cannabis sales in the state to date. < Previous Next > Recent Reviews Cake Boss - Fluent, Clearwater (Florida Medical) Cake Boss, available at Fluent dispensary in Clearwater, Florida, is a slightly indica-dominant hybrid strain (60% indica, 40% sativa) th... • New Hampshire House Committee Advances Adult-Use Cannabis Bill  | Toker's Guide

The New Hampshire House Commerce Committee advanced an adult-use cannabis bill that would legalize cannabis for adults 21-and-older, allow home cultivation, and tax products under the state's existing rooms and meals tax, potentially generating $27 million annually. The proposal does not include a cap on cannabis businesses. Opponents, like State Rep. John Potucek, state that the Senate and the governor oppose the measure. < Back New Hampshire House Committee Advances Adult-Use Cannabis Bill Oct 30, 2025 TG Branfalt Ganjapreneur Article Link Facebook X (Twitter) WhatsApp LinkedIn Pinterest Copy link The New Hampshire House Commerce Committee on Tuesday advanced an adult-use cannabis bill, which could set up the legislation for a vote early next year, WMUR reports. The proposal would legalize cannabis for adults 21-and-older, allow some home cultivation, and tax products under the state’s existing rooms and meals tax, which could generate an estimated $27 million annually for the state. The proposal does not include a cap on cannabis businesses, which the bill’s sponsor, state Rep. Jared Sullivan (D) called “a big controversy” when lawmakers tried passing the reforms last year. “This is an issue that most people in New Hampshire support, and if we don’t keep talking about it, the people of New Hampshire are never going to get what they want.” — Sullivan to WMUR A previous version of the bill introduced this year died in committee and the Senate last year voted down a proposal that would have legalized cannabis for adult use but gave the state tight control over licensing. State Rep. John Potucek (R) told WMUR that, despite the bill’s passage by the Commerce Committee, “the discussion is over.” “The Senate said no,” Potucek said. “The governor says no.” < Previous Next > Recent Reviews Cake Boss - Fluent, Clearwater (Florida Medical) Cake Boss, available at Fluent dispensary in Clearwater, Florida, is a slightly indica-dominant hybrid strain (60% indica, 40% sativa) th... • Supreme Court Grants Trump Admin’s Request For Deadline Extension In Marijuana... | Toker's Guide

Supreme Court Grants Trump Admin’s Request For Deadline Extension In Marijuana And Gun Rights Case < Back Supreme Court Grants Trump Admin’s Request For Deadline Extension In Marijuana... Nov 4, 2025 Kyle Jaeger Marijuana Moment Article Link Facebook X (Twitter) WhatsApp LinkedIn Pinterest Copy link The U.S. Supreme Court has granted a request from the Trump administration to extend the deadline to submit briefs in a case concerning the constitutionality of a federal ban on gun ownership by people who use marijuana and other drugs. After justices agreed to take the case, *U.S. v. Hemani, *late last month, DOJ told the court there was mutual agreement between its attorneys and those representing the respondent in the case that the initial deadline for briefs and reply briefs should be revised because of the “press of other cases.” On Friday, the court agreed, pushing back the deadline for the government to file a brief from December 4 to December 12. A brief from the respondents will now be due by January 20, 2026 and a reply brief from the government will be due by February 19. The Trump administration has routinely argued that the policy restricting gun ownership by people who use cannabis, even in compliance with state law, “targets a category of persons who pose a clear danger of misusing firearm” and should be upheld. After several years of conflicting lower court rulings on related cases, justices granted cert in *U.S. v. Hemani *to settle the question of whether the ban—known as Section 922(g)(3)—is consistent with the Second Amendment. Meanwhile, a coalition of gun rights organizations recently urged the Supreme Court to expand its examination of the constitutionality of the federal firearm ban for cannabis consumers—telling justices that a recent case on the issue it accepted would not properly settle the question of the current law’s constitutionality. The Second Amendment Foundation (SAF) and five other gun rights advocacy groups filed an amici brief last week in a separate case on the issue pending before the justices. With respect to *Hemani*, in a separate August filing for the case, the Justice Department also emphasized that “the question presented is the subject of a multi-sided and growing circuit conflict.” In seeking the court’s grant of cert, the solicitor general also noted that the defendant is a joint American and Pakistani citizen with alleged ties to Iranian entities hostile to the U.S., putting him the FBI’s radar. Now that the Supreme Court has agreed to take up *Hemani*, if justices declare 922(g)(3) constitutional, such a ruling could could mean government wins in the remaining cases. The high court last month denied a petition for cert in *U.S. v. Cooper*, while leaving pending decisions on *U.S. v. Daniels* and *U.S. v. Sam*. The court also recently denied a petition for cert in another gun and marijuana case, *U.S. v. Baxter, *but that wasn’t especially surprising as both DOJ and the defendants advised against further pursing the matter after a lower court reinstated his conviction for being an unlawful user of a controlled substance in possession of a firearm. Meanwhile, in recent interviews with Marijuana Moment, several Republican senators shared their views on the federal ban on gun possession by people who use marijuana—with one saying that if alcohol drinkers can lawfully buy and use firearms, the same standard should apply to cannabis consumers. Separately, the U.S. Court of Appeals for the Tenth Circuit earlier this year sided with a federal district court that dismissed an indictment against Jared Michael Harrison, who was charged in Oklahoma in 2022 after police discovered cannabis and a handgun in his vehicle during a traffic stop. The case has now been remanded to that lower court, which determined that the current statute banning “unlawful” users of marijuana from possessing firearms violates the Second Amendment of the Constitution. The lower court largely based his initial decision on an interpretation of a Supreme Court ruling in which the justices generally created a higher standard for policies that seek to impose restrictions on gun rights. Separately, in the U.S. Court of Appeals for the Eleventh District, judges recently ruled in favor of medical cannabis patients who want to exercise their Second Amendment rights to possess firearms. As a recent report from the Congressional Research Service (CRS) explained the current legal landscape, a growing number of federal courts are now “finding constitutional problems in the application of at least some parts” of the firearms prohibition. In a recent ruling, a three-judge panel for the U.S. Court of Appeals for the Eighth Circuit vacated a defendant’s conviction and remanded the case back to a district court, noting that a retrial before a jury may be necessary to determine whether cannabis in fact caused the defendant to be dangerous or pose a credible threat to others. The Third Circuit separately said in a published opinion that district courts must make “individualized judgments” to determine whether 922(g)(3) is constitutional as applied to particular defendants. A federal court last month agreed to delay proceedings in a years-long Florida-based case challenging the constitutionality of the ban on gun ownership by people who use medical marijuana, with the Justice Department arguing that the Supreme Court’s recent decision to take up *Hemani* warrants a stay in the lower court. *— Marijuana Moment is tracking hundreds of cannabis, psychedelics and drug policy bills in state legislatures and Congress this year. Patreon supporters pledging at least $25/month get access to our interactive maps, charts and hearing calendar so they don’t miss any developments.* *Learn more about our marijuana bill tracker and become a supporter on Patreon to get access. —* Earlier this year, a federal judge in Rhode Island ruled that the ban was unconstitutional as applied to two defendants, writing that the government failed to establish that the “sweeping” prohibition against gun ownership by marijuana users was grounded in historical precedent. A federal judge in El Paso separately ruled late last year that the government’s ongoing ban on gun ownership by habitual marijuana users is unconstitutional in the case of a defendant who earlier pleaded guilty to the criminal charge. The court allowed the man to withdraw the plea and ordered that the indictment against him be dismissed. DOJ has claimed in multiple federal cases over the past several years that the statute banning cannabis consumers from owning or possessing guns is constitutional because it’s consistent with the nation’s history of disarming “dangerous” individuals. In 2023, for example, the Justice Department told the U.S. Court of Appeals for the Third Circuit that historical precedent “comfortably” supports the restriction. Cannabis consumers with guns pose a unique danger to society, the Biden administration claimed, in part because they’re “unlikely” to store their weapon properly. Meanwhile, some states have passed their own laws either further restricting or attempting to preserve gun rights as they relate to marijuana. Recently a Pennsylvania lawmaker introduced a bill meant to remove state barriers to medical marijuana patients carrying firearms. Colorado activists also attempted to qualify an initiative for November’s ballot that would have protected the Second Amendment rights of marijuana consumers in that state, but the campaign’s signature-gathering drive ultimately fell short. As 2024 drew to a close, the ATF issued a warning to Kentucky residents that, if they choose to participate in the state’s medical marijuana program that’s set to launch imminently, they will be prohibited from buying or possessing firearms under federal law. The official said that while people who already own firearms aren’t “expected to” turn them over if they become state-legal cannabis patients, those who “wish to follow federal law and not be in violation of it” must “make the decision to divest themselves of those firearms.” Since then, bipartisan state lawmakers have introduced legislation that would urge Kentucky’s representatives in Congress to amend federal law to clarify that users of medical marijuana may legally possess firearms, though no action has since been taken on that bill. Kentucky Gov. Andy Beshear (D) said in January that he supported the legislature’s effort to urge the state’s congressional delegation to call for federal reforms to protect the Second Amendment rights of medical marijuana patients, but the governor added that he’d like to see even more sweeping change on the federal level. In an post on X last week, Colombian President Gustavo Petro addressed broader drug policy issues amid a broader feud between the two leaders over the Trump administration’s military strikes against boats alleged to be trafficking narcotics. “Colombia actually provides the money and the deaths in the struggle, while the U.S. provides the consumption,” Petro said, according to a translation. “Consumption in the U.S. and the growing consumption in Europe are responsible for 300,000 murders in Colombia and a million deaths in Latin America.” But he also said he proposed to Trump “the opposite” of what the administration is currently doing—by removing tariffs on Colombian agriculture goods and legalizing the “export of cannabis” like “any good,” for example. Petro said that reform could be justified by the United Nations’s decision to reschedule cannabis under international treaties to which both countries are parties. Se ha construido una… https://t.co/R2SGZEnDfU — Gustavo Petro (@petrogustavo) October 20, 2025 Trump should also “strengthen the policy of prevention of consumption in the U.S.” and “scientifically study whether prohibition is necessary, or rather responsible and state-regulated consumption build a more effective treaty for the pursuit of narcos’ capital and assets in the world,” the Colombian president said, as High Times first reported. Trump last week called Petro an “illegal drug leader” and the U.S. Treasury Department’s Office of Foreign Assets Control sanctioned the Colombian president, members of his family and his advisors for alleged involvement in drug trafficking. This comes months after Colombian lawmakers gave initial approval to a bill that would nationally legalize marijuana—with a House committee in August taking the first step in an extensive legislative process to enact the reform. Petro has consistently supported legalizing cannabis—and he’s put pressure on legislators to advance the issue. He said in late 2023 that lawmakers who voted to shelve a legalization bill that year only helped to perpetuate illegal drug trafficking and the violence associated with the unregulated trade. After a visit to the U.S. in 2023, the Colombian president recalled smelling the odor of marijuana wafting through the streets of New York City, remarking on the “enormous hypocrisy” of legal cannabis sales now taking place in the nation that launched the global drug war decades ago. Petro also took a lead role at the Latin American and Caribbean Conference on Drugs in 2023, noting Colombia and Mexico “are the biggest victims of this policy,” likening the drug war to “a genocide.” In 2022, Petro delivered a speech at a meeting of the UN, urging member nations to fundamentally change their approaches to drug policy and disband with prohibition. He’s also talked about the prospects of legalizing marijuana in Colombia as one means of reducing the influence of the illicit market. And he has signaled that the policy change should be followed by releasing people who are currently in prison over cannabis. Trump, for his part, has not embraced federal legalization, though he said in late August that a decision on a pending marijuana rescheduling proposal would come within weeks. Much of his drug policy actions of late have focused on cartels, with controversial extrajudicial attacks on boats in international waters that were allegedly transporting drugs to the U.S. *Image element courtesy of Bryan Pocius.* The post Colombia’s President Tells Trump To Legalize Marijuana To Combat Illicit Drug Trade appeared first on Marijuana Moment. < Previous Next > Recent Reviews Cake Boss - Fluent, Clearwater (Florida Medical) Cake Boss, available at Fluent dispensary in Clearwater, Florida, is a slightly indica-dominant hybrid strain (60% indica, 40% sativa) th...
