Greg Abbott (R) on Sunday evening vetoed a bill to ban THC throughout the state. Championed by Lt. Gov. Dan Patrick (R) — who made banning hemp-derived THC his top priority for the year — Senate Bill 3 would have banned products containing any amount of THC, even when sourced from industrial hemp. The governor was under intense pressure to veto the bill from hemp advocates, veteran groups, and business owners. Despite passing both legislative bodies and garnering support from most of the state’s conservative lawmakers, recent polling showed the proposed ban was not popular even among Republican voters. Advocates additionally said they delivered over 180,000 petition signatures and over 5,000 handwritten letters this month asking the governor to veto the proposal. The veto came less than an hour ahead of the deadline for the governor’s decision on the issue. Lt. Gov. Patrick attacked Abbott following the veto, writing on X: “Throughout the legislative session, @GregAbbott_TX remained totally silent on Senate Bill 3, the bill that would have banned dangerous THC products in Texas. His late-night veto, on an issue supported by 105 of 108 Republicans in the legislature, strongly backed by law enforcement, many in the medical and education communities, and the families who have seen their loved ones’ lives destroyed by these very dangerous drugs, leaves them feeling abandoned.” — Patrick, in a social media post The governor also decided on Saturday to sign into law a proposal expanding the state’s limited cannabis program to cover new qualifying conditions and cannabis delivery methods. Previously, the Texas Compassionate Use Program (TCUP) only allowed access to very low levels of THC, and for very few patients. Changes to the program will include adding traumatic brain injuries, chronic pain, and a terminal illness or condition that requires hospice as qualifying conditions to the program. Additionally, the program will allow for vaporized or aerosolized medical cannabis delivery – smoking, however, will remain banned under the new law. These sugars are the building blocks of all plant matter – including roots, stems, leaves, buds, cannabinoids, and terpenes. Remarkably, the plants you grow on your farm literally come out of the air when CO2 is taken up through stomata openings of the plants’ leaves. Growers spend a lot of time and effort preparing the soil (the source of primary and trace nutrients), irrigating, and ensuring there is sufficient light. Like compound interest, these early “investments” in plant structure support the creation of additional biomass as the plant matures. The best results from CO2 enrichment are realized when it’s applied to both the vegetative and flowering stages. The question of the legality of the drinks came up Thursday at a meeting of a joint legislative committee on security. Robert Stuart, executive officer for the Kansas Bureau of Investigation, explained to lawmakers that while marijuana is illegal in Kansas, THC-infused beverages are considered hemp products and allowed under the 2018 federal Farm Bill, which legalized cannabis plants containing no more than 0.3 percent of a plant’s weight in tetrahydrocannabinol, or THC. Products created using hemp are commonly advertised as Delta 9 items, and they can have a weaker effect than marijuana because of their lower THC content. Rep. Pat Proctor, a Republican from Leavenworth, asked Stuart: “Should we be outlawing it?” Yes, Stuart said, and he wagered the KBI’s position would be the same. “If it’s intoxicating, it’s damaging,” he said. THC drinks are restricted to adults over the age of 21, same as alcoholic beverages. “You hear all sorts of social arguments and all sorts of different ways of thinking about it,” Stuart said, “but it would be much clearer for any of those distributors, any of those dealers, for any member of the public, to say, OK, this is what’s clearly illegal and clearly what’s not.” Blurred lines make it difficult for retailers to comply with state laws, for consumers to know the products they purchase are safe and for law enforcement to conduct criminal investigations, Stuart said. Kansas City, Missouri-based brewer Boulevard Brewing Company announced this month a THC-infused version of its signature Quirk seltzer, which will be called “Berry Jane.” It will be available in two dosages. One containing 5 mg THC and another containing 10 mg, differentiated by a darker can. They are expected to be sold in Kansas and Missouri next month. The KBI celebrated a major crackdown on THC products earlier this month, raiding 10 storefronts in six cities across the state. Unlike the previous version of the federal webpage, the new one explicitly lists cannabis among the products that can’t be purchased with the benefits. “Households CANNOT use SNAP benefits to buy…Food and drinks containing controlled substances such as cannabis/marijuana,” it now says. Other SNAP-restricted items include alcohol, cigarettes, vitamins, pet food and foods that are hot at the point of sale. But for reasons that aren’t clear, this is the second cannabis-related update to the FAQ in a matter of days. An initial update last week specified that SNAP benefits couldn’t go toward “cannabis-derived products, such as CBD, and any other controlled substances.” That CBD-specific language was quickly removed, however. Marijuana Moment reached out to USDA for clarification, but a representative was not immediately available. In any case, the new FAQ language doesn’t necessarily represent a policy change, as USDA first issued guidance in 2020 stipulating that while people can use SNAP benefits for certain foods containing “hulled hemp seed, hemp seed protein powder, and hemp seed oil,” they cannot buy “hemp plants, leaves, and shoots.” USDA further clarified at the time that foods “containing cannabis-derived products, such as CBD, and any other controlled substances, are not eligible to be purchased with SNAP benefits,” similar to what’s articulated in the latest update to the FAQ. The same language was maintained in another update last year. Why the agency determined that its important to clarify the cannabis prohibition on its FAQ page now is unclear, but it comes at a time when many in the cannabis space are closely watching for signals about how the administration will navigate marijuana and hemp issues during President Donald Trump’s second term. In his first term, Trump signed the 2018 Farm Bill that federally legalized hemp, creating an industry that has since experienced significant volatility amid concerns about the resulting proliferation of a largely unregulated market for intoxicating cannabinoid products. But despite signing that legislation into law—and later endorsing marijuana rescheduling and industry banking access on the 2024 campaign trail—the president hasn’t publicly commented on cannabis policy issues since taking office in January. Meanwhile, a pair of GOP-led congressional bills filed earlier this month would prevent people from using federal financial assistance under the Temporary Assistance for Needy Families (TANF) program at cannabis dispensaries. Back at USDA, the agency recently released a noticed that it is terminating a series of trade advisory committees to comply with an executive order Trump signed in February that’s meant to reduce the size of the federal government across multiple agencies. One of those committees that had been expanded to include hemp industry representatives to promote the crop internationally. Meanwhile, a report released by USDA last month found that, even as more states and some congressional lawmakers pursued bans on consumable hemp products, the industry saw significant growth in 2024. The National Hemp Report, which USDA conducts annually to assess the economic health of the market, showed that hemp farmers cultivated 45,294 acres of the crop last year, up 64 percent from 2023.
