Virginia lawmakers passed a bill to protect the custody and visitation rights of parents who legally use marijuana, ensuring that legal consumption alone cannot be used to restrict those rights. The legislation now awaits action from Governor Abigail Spanberger, who is generally supportive of marijuana reform.

Marijuana Moment

Virginia is finally making moves to ensure that being a cannabis-loving parent doesn’t automatically put your family at risk. Lawmakers just passed a crucial bill that prevents the state from using legal marijuana consumption as the sole reason to restrict child custody or visitation rights. Essentially, as long as you’re following state law and your use isn’t harming the kid’s best interests, your parental rights stay protected. This same bill was vetoed twice by the previous governor, but with Abigail Spanberger now in the hot seat, advocates are feeling way more optimistic about it becoming law.

This is a massive win for the community because it starts to dismantle the outdated stigma that you can’t be a responsible parent and a cannabis consumer. For years, tokers have lived in fear that a legal hobby could be weaponized against them in family court. By codifying these protections, Virginia is acknowledging that responsible adult use shouldn't be a dealbreaker for family life, bringing cannabis closer to the same social standing as a glass of wine at dinner.
