Parents of would-be medical cannabis patients in Alabama are suing the state Medical Cannabis Commission (AMCC) over delays in implementing the medical cannabis program. The lawsuit contends that the AMCC has failed to perform its duty by not registering patients or caregivers by the mandated deadline. The lawsuit, filed by five parents, contends that the Darren Wesley “Ato” Hall Compassion Act, signed into law nearly five years ago, mandated the creation of a system to track qualified patients and caregivers, and used mandatory language requiring action by a specific deadline – giving the AMCC no discretion on timelines – but the state has not yet registered patients or caregivers. “The Commissioners have failed to perform their nondiscretionary, ministerial duty,” the lawsuit states. “Mandamus is the only adequate remedy available.” The lawsuit includes a snapshot of the years of disfunction at the AMCC – violations of the state’s Open Meetings Act and Alabama Administrative Procedure Act (AAPA) – calling them “egregious.” “The Commissioners’ failure to establish a patient registry with actual patients has delayed the availability of medical cannabis to patients just as surely as the Commission’s repeated refusal to follow the Open Meetings Act and AAPA.” —* State of Alabama ex rel. vs. Alabama Medical Cannabis Commission* Under the law, the Commission was directed to create the patient and caregiver registry by September 1, 2022. [image: 14-CANNA-BRAND-ARCHETYPES.png] *The 14 Cannabis Brand Archetypes* Brand archetypes categorize universal patterns we intuitively know; helping us to quickly understand a brand’s point of view. And as such, they are an effective marketing “short-cut” embodying common elements. Applying these elements to a brand, helps potential customers identify and understand it – instantly. While all brands are bound to play within the rules and regulations of their respective states and municipalities, they must seek creative ways to make the laws work best for their businesses and more effectively than their competitors in order to succeed. The number one critical success factor is consistency. A readily available product with a consistent look, feel, dose and flavor is crucial. While consistency might sound inflexible, it is not meant to be. Through consistency, one can better chart a brand roadmap that’s in line and suits the customer’s needs. The cannabis sector is forever shifting. The fewer moving parts in the equation, the easier it is to contain and control the variables. Calling out specific attributes is difficult as canna-products cross a wide range of form factors, demographics and usage scenarios. Why do we expect to see cannabis-infused edibles packaged like other baked goods and candies? Or cannabis-infused transdermal patches packaged like Band Aids®? Or cannabis-infused sublingual slips packaged like Listerine® breath strips? [image: kinslips.jpg] The answer is: We have pre-conceived notions about brands and their products; how they’re packaged and under what circumstances we use them. A child-resistant cap or tamper-proof package immediately puts us at ease and makes us feel assured about our safety and consumption. Brands and color are inextricably linked because color offers an instantaneous method for conveying meaning and message without words. Color is the visual component people remember most about a brand followed closely by shapes, symbols, numbers, and finally words. In a world where appropriation and mash-ups abound, it’s no surprise that brand archetypes often overlap and are not mutually exclusive. Meaning, many brands span one or more archetype categories. [image: Blaze.jpg] *THE FOLLOWING REPRESENTS THE FOURTEEN MOST PROMINENT CANNABIS BRAND ARCHETYPES:* *1. COUNTER-CULTURE* Counter-culture brands are those brands that serve consumers who often define themselves and their activities through rebellion (i.e. not belonging to a certain group) counter cultures simply ‘feed the flames’ of consumer culture by creating a whole new set of goods for ‘rebel consumers’. *2. NOSTALGIC* Research shows that nostalgia gives our lives a sense of continuity and meaning as we get older. As we age, we all develop fond memories of our younger days, from the food we ate, to the games we played, to the music we listened to. It’s no surprise many cannabis brands use nostalgia as a brand pillar. [image: properchocolate.jpg] *3. NOVELTY* When a consumer encounters a novel image tied to a brand, they are driven to learn more about it. They compare it to existing information: is it new and how does it fit into what they already know? Novelty is a powerful tool; but, it’s also a dangerous one. The key to using novelty to attract interest, is to make sure it’s a new expression of something the brand always stood for. A great example of a novelty brand is “Impeachmints” manufactured by Evergreen Herbal. *4. FOODIE* Understanding how farm and food relate is essential for marketing to this sought-after demographic. Marketing to Foodies requires staying up to date on the latest trends across the food world. Given the increased importance everyone is placing on food, marketers would be wise to stay current. With the interconnectedness of food culture to almost everything, the relationship with cannabis is clear. [image: salted.jpg] *5. REGIONAL* A regional brand reflects the culture and qualities of a particular appellation or terroir. Examples of cannabis strains boasting their geographic origin include Maui Wowie, Durban Poison, Acapulco Gold and Humboldt OG, to name a few. That said, it’s no surprise that many brands seek to capture and leverage these nuanced, regional, and cultural qualities into their brands. *6. HEALTH & WELLNESS* Health and wellness brands have honed their messages putting customer’s well-being front and center. They typically focus on product quality, efficacy, benefits, and an overall balanced lifestyle. Successful brands in the health and wellness space do best when they provide their customers with aspirational content, as well as easy access to information and tools that allow them to embrace a healthy lifestyle. *7. CELEBRITY* Celebrity branding is a marketing strategy used by leveraging the celebrity’s social status or fame to help promote a product or service. Brands use celebrities in hopes that the persona and image of the celebrity will be passed on to the product(s) and/or the brand associated with the celebrity. *8. PROHIBITION * Prohibition refers to the banning of the manufacture, storage (whether in barrels or in bottles), transportation, sale, possession, and consumption of alcoholic beverages. The word is also used to refer to a period of time during which such bans are enforced. Today, many cannabis brands are connecting the concept of alcohol prohibition to cannabis legalization. Examples of these prohibition brands include Zoots and Lowell Herb Co. among others. *9. ART & DESIGN* The relationship between art and commerce has always been filled with anxiety. The diminishing impact of traditional advertising has caused brands to seek new ways to capture the attention of consumers. Artists and the art market have taught us how valuable a brand can become by leveraging art and artists. Seattle-based Saints Joints is a perfect example of a cannabis brand working with artists to create collectible, limited edition box packaging. [image: saint_joints.jpg] *10. GENDER FOCUSED * While statistics tell us the majority of cannabis consumers are male, the female and LGBTQ segments are an under-developed opportunity — possibly the number one opportunity for those who understand how sexuality, gender, and political perspective resonate in this segment. While many have tried to “pink it & shrink it”, we certainly know that strategy hasn’t worked for brands outside of the cannabis industry. *11. VALUE* A "budget brand" is a brand whose major selling point is its low price and/or value offering. Often, but not always; that may mean lower quality. Since COVID-19, there has been an increase in larger, pre-packaged product offerings, such as pre-ground flower in pouches – rolling papers included. *12. CANNABIS CULTIVATOR * Cultivator brands have taken off with the interest and development in strains, terpenes, and cannabinoids. Cookies is a perfect example of how a brand can grow from strain genetics. Well-known cultivators and cultivator brands include Sherbinskis, Cookies, Exotics, and Ed Rosenthal, among others. *13. LUXURY* Luxury cannabis brands are those that comprise associations of high price, high quality, beauty, rarity, and perhaps, even a degree of non-functionality. One of the best examples of a cannabis luxury brand is the Leira Cannagar, called out by Forbes Magazine as a “gourmet ultra-luxury cannagar.” [image: schoko.jpg] *14. CHARITY | SOCIAL JUSTICE* People’s willingness to devote their loyalty and money to a cause is directly influenced by the positive connection they have with a brand. The right image, personality, and tone of voice create an identity that your customers (and donors) can relate to, which leads to more sales and better fundraising. A great example of a cannabis charity brand is California’s GIVE. *SUMMARY * How consumers attach themselves to a brand is based on the brand’s ability to tell its story to its customer. A health and wellness brand should not brand and market its product in the same way a recreational brand focused on rebellion would. Different customer segments demand different products, whether real or perceived. It behooves brands to creatively leverage the most recognizable brand archetype elements in order to effectively and efficiently convey who they are and what they stand for. A newly announced Republican candidate for governor of Wisconsin, Bill Berrien, is open to considering legalizing medical or adult-use marijuana, specifically suggesting tax funds from THC-infused drinks for corporate attraction. Governor Tony Evers (D) supports legalization and believes a Democratic trifecta in the legislature could lead to it, stopping revenue from going to neighboring Illinois. A recent poll shows 67% of Wisconsin voters support marijuana legalization, with Democrats and independents largely in favor, but a majority of Republicans still opposed to adult-use legalization. Despite Republican resistance in the legislature, some GOP leaders acknowledge the debate over medical marijuana will not go away. Past attempts at legalization have stalled, but efforts continue, with projections showing significant tax revenue from reform. < Back Republican Candidate For Wisconsin Governor Says He’s ‘Open’ To Marijuana Legalization Jul 11, 2025 Ben Adlin Marijuana Moment Article Link Facebook X (Twitter) WhatsApp LinkedIn Pinterest Copy link A newly announced Republican candidate for governor of Wisconsin said this week that he’s “open to considering different opportunities” when it comes to legalizing medical or adult-use marijuana in the state, though he has provided little in the way of specifics so far. “I would be open to considering different opportunities there,” manufacturing company CEO Bill Berrien, a former Navy SEAL, told the Milwaukee Journal Sentinel in an interview published on Wednesday announcing his campaign. “Maybe around taking THC-infused drinks and pushing those tax funds towards corporate attraction, business attraction, business investment. So, open to considering some of those ideas.” The report didn’t elaborate on how Berrien might use tax revenue from THC beverages to attract business investment. For now, cannabis remains illegal in Wisconsin for both medical and adult use. Berrien in the new interview also described himself as generally in line with President Donald Trump’s actions during his second term. It’s not clear what that might mean in terms of cannabis policy, as reform actions in Congress and within the executive branch have broadly stalled since Trump returned to office earlier this year. The only other declared Republican candidate in the gubernatorial primary is Washington County Executive Josh Schoemann, who entered the race in May. Meanwhile on the Democratic side, current Gov. Tony Evers (D), who supports legalizing cannabis, has yet to announce whether he’ll seek re-election. During a speech at the Democratic Party of Wisconsin’s 2025 convention last month, Evers said that if his party can take control of the legislature, the state can “finally” legalize marijuana so that residents don’t have to go to neighboring Illinois to visit its adult-use market. Speaking at the Democratic Party of Wisconsin’s 2025 convention Evers said that “Republicans better start getting used to Democrats being in power in the state,” as a new redistricting map he approved last year could deliver the party a “Democratic trifecta,” with control of the Assembly, Senate and governor’s office. That would free up lawmakers to overcome roadblocks in the currently conservative legislature that have prevented the advancement of several key issues, including health care expansion, parental leave and, “yes, we could finally legalize marijuana so we can stop sending our revenue down to my good friend, [Gov. J.B. Pritzker (D)] down in Illinois,” he said. Senate Minority Leader Dianne Hesselbein (D) also briefly touched on the issue at party convention, saying “we will also legalize cannabis” among other priorities in the Democratic agenda if the party wins a legislative majority in next year’s elections. Separately last month, a new poll from Marquette Law School found that two in three Wisconsin voters support legalizing marijuana. The survey found that support for cannabis reform has generally increased over time since the institution first started tracking public opinion on legalization in 2013, with 67 percent of voters now backing the policy change. That’s 17 percentage points higher than the 2013 results. Democrats are the most likely to favor legalizing cannabis, at 88 percent, followed by independents (79 percent). However, a majority of Republicans (56 percent) said they’re still opposed to adult-use legalization. Underscoring the importance of party control, the state’s Republican-controlled Senate and Assembly last week rejected another attempt to legalize marijuana, defeating amendments to budget legislation that would have ended prohibition in the state and established new medical and recreational cannabis programs. Evers has routinely attempted to change that policy as part of his budget requests—and Democratic leaders have similarly pushed for reform. Republicans in the legislature also cut the marijuana provisions from a state budget proposal in May, as they’ve done in past sessions. Despite Republicans’ move to cut legalization from the budget legislation, party leaders recently acknowledged that the debate over medical marijuana legalization is “not going to go away,” and there’s hope it can be resolved this session. “I don’t think anyone is naive enough to think that marijuana and THC products aren’t present in the state of Wisconsin when they are readily available over state lines, so I think we need to come to an answer on this,” Assembly Majority Leader Rep. Tyler August (R) said in February. “I’m hopeful that we can.” “If we’re going to call it medical marijuana, it needs to be treated like a pharmaceutical. But the marijuana debate is going to be something that is not going to go away,” Sen. Dan Feyen (R), the assistant majority leader, said at the time. “The margins are tighter.” There have been repeated attempts to legalize medical marijuana in the legislature over recent years, including the introduction of legislation from Assembly Speaker Robin Vos (R) that called for a limited program facilitated through state-run dispensaries. That proved controversial among his Republican colleagues, however, and it ultimately stalled out last year. Evers previewed his plan to include marijuana legalization in his budget in January, while also arguing that residents of the state should be allowed to propose new laws by putting binding questions on the ballot—citing the fact that issues such as cannabis reform enjoy sizable bipartisan support while the GOP-controlled legislature has repeatedly refused to act. Previously, in 2022, the governor signed an executive order to convene a special legislative session with the specific goal of giving people the right to put citizen initiatives on the ballot, raising hopes among advocates that cannabis legalization could eventually be decided by voters. The GOP legislature did not adopt the proposal, however. Evers said in December that marijuana reform is one of several key priorities the state should pursue in the 2025 session, as lawmakers work with a budget surplus. Days after he made the remarks, a survey found the reform would be welcomed by voters in rural parts of the state. Nearly two thirds (65 percent) said they support legalizing cannabis. Last May, the governor said he was “hopeful” that the November 2024 election would lead to Democratic control of the legislature, in part because he argued it would position the state to finally legalize cannabis. “We’ve been working hard over the last five years, several budgets, to make that happen,” he said at the time. “I know we’re surrounded by states with recreational marijuana, and we’re going to continue to do it.” A Wisconsin Democratic Assemblymember tried to force a vote on a medical cannabis compromise proposal last year, as an amendment to an unrelated kratom bill, but he told Marijuana Moment he suspects leadership intentionally pulled that legislation from the agenda at the last minute to avoid a showdown on the issue. Meanwhile, the state Department of Revenue released a fiscal estimate of the economic impact of a legalization bill from then-Sen. Melissa Agard (D) in 2023, projecting that the reform would generate nearly $170 million annually in tax revenue. A legislative analysis requested by lawmakers estimated that Wisconsin residents spent more than $121 million on cannabis in Illinois alone in 2022, contributing $36 million in tax revenue to the neighboring state. The fiscal impact included on the bills warn that the license restrictions “would create regional monopolies or oligopolies preventing new businesses from entering” the state’s adult-use and medical cannabis markets and that small cities and villages would likely see their cannabis tax revenues reduced. In a statement, state Sen. Sam Singh (D), sponsor of the bill to restrict cannabis retailer licenses (SB.597), said the proposal “offers a lifeline to existing businesses and a common-sense approach to addressing the growing threats faced by our retailers.” “Michigan’s burgeoning cannabis industry has been a boon to our economy, supporting nearly 50,000 jobs while providing additional, critical ways for residents to manage a wide range of mental and physical health issues.” — Singh in a press release Robin Schneider, executive director of the Michigan Cannabis Industry Association, backed the license restriction plan. “Addressing unlimited and overcrowding licenses will create better market stability for our members,” she said in a statement. Another two-bill package would extend the state’s cannabis regulatory framework to consumable hemp processors, establishing an application process for consumable hemp manufacturing, creating allowable activities for hemp processors, defining responsibilities of the CRA related to hemp, and creating penalties for violations. The proposals would also ban the importation of untested, unregulated, untaxed, and unrestricted-by-age intoxicating hemp-derived products. In a statement, state Sen. Dayna Polehanki (D), sponsor of the bills seeking to create the new regulations for consumable hemp products (SB.599 and SB.602), said that while the state’s cannabis industry “has become an important pillar” of Michigan’s economy, “with that growth comes an obligation” to ensure the safety and responsible marketing of intoxicating hemp-derived products. Kennedy Jr., who said recently that his aim is to free up plant-based medicine options within 12 months. “VA is challenging the status quo to find new ways of helping Veterans. To that end, VA is conducting 11 clinical studies of potential psychedelic-assisted therapies,” Collins said following the meeting with the lawmakers. “I appreciate the leadership of Reps. Under appropriations legislation that was enacted last session, DOD is already mandated to conduct the trials, with $10 million in previously provided funding, to investigate the medical value of psychedelics for active duty military members. The action blocking the amendment to the spending bill from advancing comes as bipartisan lawmakers and stakeholders continue to see other advances in the debate over psychedelic medicine. For example, former U.S. House Speaker Newt Gingrich (R-GA) recently said the psychedelic ibogaine represents an “astonishing breakthrough” in the nation’s current “sick care system” that’s left people with serious mental health conditions without access to promising alternative treatment options—and he intends to use his influence to advance the issue. Meanwhile, a Navy SEAL veteran credited with killing Osama Bin Laden said during a Fox News interview last week that psychedelic therapy has helped him process the trauma he experienced during his time in the military, stressing that “it works” and should be an available treatment option. That interview came days after the U.S. House of Representatives included an amendment to a spending bill from Correa and Bergman that would encourage VA to support research into the benefits of psychedelics in treating medical conditions commonly affecting military veterans. Collins, for his part, also disclosed in April that he had an “eye-opening” talk with Kennedy about the therapeutic potential of psychedelic medicine. And he said he’s open to the idea of having the government provide vouchers to cover the costs of psychedelic therapy for veterans who receive services outside of VA as Congress considers pathways for access. Collins also recently visited a facility conducting research on psychedelics, and he reiterated that it’s his “promise” to advance research into the therapeutic potential of the substances—even if that might take certain policy changes within the department and with congressional support. The secretary’s visit to the psychedelics research center came about a month after the VA secretary met with a military veteran who’s become an advocate for psilocybin access to discuss the therapeutic potential of psychedelic medicine for the veteran community. Collins also briefly raised the issue in a Cabinet meeting with President Donald Trump in April. Last year, VA’s Yehuda also touted an initial study the agency funded that produced “stunning and robust results” from its first-ever clinical trial into MDMA therapy. This year, why not try toasting in the new year with a delicious marijuana mocktail instead? We’ve provided recipes for two alternative ways to celebrate. The first is a sweet, tangy, good and good-for-you cannabis-infused shrub. Shrubs, or “drinking vinegars,” originally developed as a way to settle the stomach during the pre-refrigeration era, and have been coming back in popularity as a versatile, flavorful ingredient in craft cocktails that adds the natural health benefits of fermentation and vinegar. The second is a refreshing drink that draws in pomegranate, a tart and beautiful seasonal winter fruit. Marijuana mocktails give you the option of a very adult way to celebrate and get buzzed, without the guilt of ravaging your health and well-being that often accompanies consuming too much alcohol. Plus, no hangover! Just glorious, deep sleep. What a time to be alive! All things in moderation, as the saying goes. The shrub recipe is for a very potent 25 mg of THC per serving, so if you’re planning on having quite a few, or prefer a lighter version, half the amount of cannabis for 12 1/2 mg of THC per drink, and so on. Take it slow, allowing at least an hour before consuming another drink, and pay attention to other variables such as what and how much you’ve eaten that day. Enjoy these delicious marijuana mocktails and cheers to a healthy 2024! Cranberry Rosemary Cannabis Shrub Inspired by a recipe by Becky Streipe for a sweet orange rosemary shrub. Makes approximately 3 cups of infused liquid. - 2 grams of 15% THC cannabis flower = 300 mg THC - 6 1/2 cup (4 oz) serving = 25 mg THC per serving - Yield: 6 1/2 cup (4 oz) drinks *Ingredients* - 2 grams 15% or higher THC-cured cannabis flower - 1 cup white cranberry juice - 1 cup sugar - 1 cup apple cider vinegar - 1/2 tbsp liquid sunflower lecithin - 2 sprigs of fresh rosemary (plus more for garnish) - Chilled sparkling water - Orange peel for garnish - Fresh cannabis leaves for garnish, if available *Instructions* (Pro tip: Prep a day ahead of time to let the smell of vinegar fade before guests arrive. Any leftovers can be refrigerated for up to two months.) 1. Grind cannabis and spread evenly on a baking sheet. Put in the oven for an hour at 240 degrees Fahrenheit to decarboxylate the cannabis (to transform the THCA into active THC) 2. In a small saucepan over medium heat, combine the cranberry juice, sugar, apple cider vinegar, and 2 sprigs of rosemary. 3. Bring to a simmer and stir for 10 minutes. 4. Add the decarboxylated cannabis, mix thoroughly. 5*.* Add 1/2 tbsp liquid sunflower lecithin and mix thoroughly. 6. Let cool to room temperature. 7. Carefully strain solids out of the liquid with a cheesecloth or coffee filter and funnel into a clean glass jar with an airtight lid. *To serve* 1. Pour 1/2 cup infused drinking vinegar into each glass for serving. 2. Add chilled sparkling water and stir. 3. Add ice, then garnish with a sprig of rosemary, an orange peel, and the cannabis leaf. (I like to add a leaf as an easy visual indicator of which drink is cannabis-infused, so party guests don’t forget.) The Seasonal Pomegranate Marijuana Mocktail is refreshingly tart. Seasonal Pomegranate Marijuana Mocktail If the starting cannabis flower is about 10% THC, then 4 grams equals 400 mg THC total. As the recipe makes 3 cups of liquid/24 oz, each oz would contain about 16-17% THC. Since the mocktail calls for 3 oz of simple syrup, each drink would have 50mg of THC per serving, which is intended for a heavy user with no major plans for the evening. I’d alter the recipe to 1 oz infused simple syrup for a light cannabis consumer, for a drink with 16-17% THC, and 2 oz infused syrup for a medium tolerance, for a drink with about 33 per activated THC per serving. (Because of the way the drink is built, the sweetness of the syrup can be offset by the amount of sparkling water added to suit taste preference/dosage strength per mocktail.) *Ingredients* - 3 oz cannabis simple syrup - Pomegranate sparkling water (can be substituted with regular sparkling water or club soda) - Pomegranate seeds - Cannabis leaf for garnish *Instructions* (Pro tip: leave the fresh leaf in the drink so the cannabis drinks will be easily identifiable) 1.
